What Is the 30 Minute Heating Rule?

The "30 minute heating rule" is a standard from England and Wales — not New York City. It refers to a landlord's obligation to provide working heating within 30 minutes of a tenant's request. NYC has a different, stricter system: landlords must maintain minimum temperatures continuously during Heat Season (October 1–May 31), not just on request.

  • In NYC: heat must be maintained at 68°F (6am–10pm) and 62°F (overnight) throughout Heat Season — the obligation is continuous, not on-demand
  • A single failure is a Class C HPD violation requiring correction within 24 hours — there is no "30 minute window" in NYC law
  • File a 311 complaint immediately if your heat goes out; HPD is required to inspect Class C violations within 24 hours of a complaint
  • The 30-minute rule from UK housing law does not apply to NYC tenants or landlords — NYC is governed by Administrative Code §27-2029
